Terms of Use

These terms govern access to and use of the public ERSA website.

1. Acceptance and scope

By accessing or using this website, you acknowledge these Terms of Use. If you do not agree, do not use the website. Separate signed agreements control any ERSA client, partner, contractor, employment, investment, confidentiality, or other formal relationship and prevail over these website terms to the extent of a conflict.

2. Informational purpose only

The website provides general information about ERSA, its operating philosophy, capabilities, leadership, and selected development activities. It is not engineering, legal, tax, investment, safety, employment, procurement, or other professional advice for a specific condition.

3. No offer, commitment, or relationship

Website content does not constitute a binding offer, proposal, guarantee, solicitation, representation of availability, or commitment to perform services or complete a transaction. Accessing the website or sending an inquiry does not create a client, consultant, fiduciary, partnership, joint-venture, agency, employment, investor, or other formal relationship. Any engagement requires a separate written agreement signed by authorized parties.

4. Email inquiries are not confidential or formal notice

Do not send confidential, privileged, classified, export-controlled, regulated, or highly sensitive information through the public email pathway. Unless ERSA has already entered a written confidentiality agreement that expressly covers the communication, sending an inquiry does not create a confidentiality obligation. An email inquiry is not legal notice, contractual notice, service of process, claim notice, bid, proposal, or instruction to proceed.

5. Accuracy and development status

ERSA intends to describe its organization and activities accurately, but website content may be incomplete, change without notice, or reflect a controlled development status. A concept, development program, strategic discussion, or reserved page architecture must not be interpreted as proof of deployment, commercial readiness, performance, client authorization, funding, partnership, endorsement, or regulatory approval.

6. Intellectual property

The ERSA name, marks, graphics, frameworks, text, page design, publications, and other website materials are owned by ERSA or used with permission unless stated otherwise. You may view and print limited material for legitimate internal evaluation. You may not reproduce, modify, republish, distribute, sell, create derivative works from, or use website materials to imply an ERSA relationship without written authorization or a right provided by law.

7. Acceptable use

You may not use the website to violate law; interfere with security or operation; introduce malicious code; probe or bypass access controls; impersonate another person or organization; submit false or unlawful material; harvest contact information; conduct automated extraction at a volume that burdens the site; or represent that ERSA has approved, endorsed, partnered with, or retained you when it has not.

8. Third-party references and links

A reference or link to a third party does not by itself establish endorsement, partnership, authorization, or responsibility. ERSA does not control and is not responsible for third-party websites, content, availability, security, or privacy practices.

9. Website availability and disclaimers

Subject to applicable law, the website and its content are provided on an “as available” basis without a promise that access will be uninterrupted, error-free, secure, or suitable for a particular purpose. ERSA may modify, suspend, restrict, or discontinue any part of the website.

10. Limitation of liability

To the fullest extent permitted by applicable law, ERSA and its members, leaders, personnel, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of, inability to use, or reliance on the public website. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

11. Governing law and forum

To the extent permitted by applicable law, these website terms and disputes arising solely from use of the public website will be governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, and brought in an appropriate state or federal court with jurisdiction in Wyoming. A separate signed agreement may establish different governing law, venue, or dispute procedures for the relationship it governs.

12. Changes and severability

ERSA may update these terms by posting a revised version and “last updated” date. If a provision is found unenforceable, the remaining provisions will continue to the extent permitted by law.
